Welcome to Future Memory! These Terms of Service ("Terms") govern your use of the Future Memory application ("App") provided by Play Build Ltd. ("we," "us," "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.
User Accounts
1. Account Creation: To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2. Eligibility: You must be at least 13 years old to use the App. By creating an account, you represent that you meet this age requirement.
User-Generated Content
1. Content Ownership: By uploading any content, including images, to the App, you grant us a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, distribute, modify, display, and create derivative works from your content.2. **Public Nature of Content**: All content uploaded to the App will become public and cannot be deleted. By uploading content, you acknowledge and agree that it will be accessible to the public indefinitely.
3. Content Guidelines: You agree not to upload content that is illegal, offensive, defamatory, or violates the rights of others. We reserve the right to remove any content that we deem inappropriate or in violation of these Terms.
User Conduct
1. Prohibited Activities: You agree not to engage in any of the following prohibited activities:
- Using the App for any illegal purpose.
- Posting or transmitting content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Posting or transmitting content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Interfering with or disrupting the App or servers or networks connected to the App.
2. Compliance with Laws: You agree to comply with all applicable laws and regulations in connection with your use of the App.
Privacy
1. Data Collection: We collect and use personal information in accordance with our Privacy Policy. By using the App, you consent to our collection and use of your personal information as described in the Privacy Policy.
2. Security: While we strive to protect your personal information, we cannot guarantee its absolute security. You acknowledge and agree that you provide your personal information at your own risk.
Intellectual Property
1. App Ownership: The App and its original content, features, and functionality are and will remain the exclusive property of Play Build Ltd. and its licensors.
2. Trademarks: The trademarks, logos, and service marks displayed on the App are the property of Play Build Ltd. You are not permitted to use these marks without our prior written consent.
Disclaimer of Warranties
1. As-Is Basis: The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's operation or the information, content, or materials included on the App.
2. No Liability: We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use the App at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Play Build Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; or (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
Indemnification
You agree to defend, indemnify, and hold harmless Play Build Ltd., its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from (i) your use of and access to the App; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Play Build Ltd. is established, without regard to its conflict of law provisions.
